Welcome to digideez (“we,” “us,” or “the Marketplace”). These Terms of Service (“Terms”) govern your access to and use of the digideez website, products, services, and digital downloads (collectively, the “Services”).
By accessing or using digideez, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to create an account or make purchases on digideez.
By using the Services, you represent that:
- You have the legal capacity to enter into these Terms
- All information you provide is accurate and current
2. Marketplace Role
digideez is a digital marketplace platform.
- We host listings from independent sellers (“Vendors”)
- Vendors are solely responsible for the products they sell
- digideez does not create, own, or control Vendor content
We facilitate transactions but are not a party to the contract between buyers and Vendors.
3. Accounts
To access certain features, you may need to create an account.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
digideez is not responsible for unauthorized access caused by your failure to secure your account.
4. Digital Products & Downloads
All products sold on digideez are digital goods unless otherwise stated.
Upon purchase, you are granted a limited, non-exclusive, non-transferable license to download and use the product for its intended purpose, subject to any license terms provided by the Vendor.
You may not:
- Resell or redistribute digital products unless explicitly allowed
- Share download files publicly or privately
- Claim ownership of Vendor content
5. Payments
- Prices are listed in U.S. dollars unless otherwise noted
- Payments are processed through third-party payment providers
- digideez does not store full payment card details
By completing a purchase, you authorize the applicable payment method for the full amount.
6. Refunds & Returns
Due to the nature of digital products, all sales are final unless:
- The product is defective
- The download fails due to a platform error
- Refunds are required by applicable law
Refund requests are reviewed on a case-by-case basis at digideez’s discretion.
7. Vendor Products & Disputes
Questions or issues related to a product should first be directed to the Vendor.
digideez may assist with dispute resolution but does not guarantee outcomes.
We reserve the right to remove products or Vendors that violate platform policies or applicable law.
8. Prohibited Use
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Attempt to access restricted areas of the site
- Upload malware, viruses, or harmful code
- Abuse, harass, or threaten Vendors or other users
Violation may result in suspension or termination of your account.
9. Intellectual Property
All site content not provided by Vendors, including branding, logos, text, graphics, and software, is owned by digideez or its licensors and protected by intellectual property laws.
You may not use digideez branding without prior written permission.
10. DMCA & Copyright Policy
digideez respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).
If you believe content on the marketplace infringes your copyright, you may submit a copyright complaint. Repeated infringement may result in account termination.
11. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
digideez makes no warranties regarding:
- Product quality or accuracy
- Vendor performance
- Availability or uptime of the platform
Use the Services at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law:
- digideez shall not be liable for indirect, incidental, or consequential damages
- digideez’s total liability shall not exceed the amount paid by you to digideez in the prior 12 months
13. Indemnification
You agree to indemnify and hold harmless digideez from any claims, damages, or expenses arising from:
- Your misuse of the Services
- Violation of these Terms
- Infringement of third-party rights
14. Termination
digideez may suspend or terminate access to the Services at any time for violations of these Terms or for legal, security, or operational reasons.
15. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.
16. Changes to These Terms
We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
